Terms and Conditions
Please read these Terms of Service (“Terms of Service”) and the Privacy Policy before registering on the online platform (https://gotalky.net/) owned by Lang Talks Information Technology Company (“the Company”) or using any part of the platform’s content (referred to here as “the Platform”), including all contents and pages within the GOTALKY electronic platform, whether online or through a mobile app, which include access to any educational content, chat rooms, or other electronic services. Both these Terms and the Privacy Policy together constitute agreements (hereinafter collectively referred to as “Agreements”) between you and “the Company.”
By using the platform, you accept and agree to be legally bound by the Agreements, whether you are a registered user of the platform or not.
The Company reserves the right to amend these Terms at any time without prior notice. Any changes made to these Terms will become effective immediately upon being posted on this page or any other section of the platform. Your continued access to the platform after any such changes constitutes your acceptance of the modified Terms and all changes included therein. Be sure to check this page periodically to stay updated on the latest version of these Terms. All services and content on the platform are the exclusive property of the Company.
About the Company
The Company is a limited liability company established under the Cairo Investment Authority. It is one of the essential elements in developing human resources and society. Believing in the importance of distance education and its impact on this system, as well as the need to develop the skills of both instructors and students to keep pace with the latest teaching methods, enabling instructors to fulfill their roles optimally and enhancing students’ research capabilities and skills, the Company decided to create its own electronic platform to serve these purposes (the “GOTALKY” platform).
User Account
To fully participate in the platform’s activities and services, you must provide your name and email address and create a password to establish a user account (referred to as “User Account”). You agree never to disclose or share your platform login or User Account information with any third party for any reason. When creating your User Account, you may be required to provide additional information (e.g., your address, phone numbers, employer, etc.). You certify that all information provided is accurate and up-to-date. You also agree to maintain and update your information to ensure it remains accurate. We care about the confidentiality and security of your personal information. Please review our Privacy Policy for more details about what information the Company may collect about you and how the Company uses that information. By accessing the platform, you consent to the collection and use of your information by the Company. If you participate in any contests organized by the Company, you agree to the publication of your details, photos, and videos on the Company’s website and social media channels.
License and Platform Access
The Company grants you a limited license to access and use this platform for personal purposes only, and not to download (other than page caching) or modify it, or any part of it, except with express written consent from the Company. This license does not include any right to resell the platform or its contents, make commercial use of the platform, collect and use any product listings or descriptions, make derivative use of the platform or its contents, download or copy account information for the benefit of another merchant, or use data mining tools, robots, or similar data extraction tools. Reproduction, duplication, copying, selling, reselling, visiting, or exploiting this platform or any part of it for commercial or non-commercial purposes without the Company’s express written consent is prohibited. Framing the platform or using framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layouts, or forms) without express written consent is prohibited. Any unauthorized use terminates the license granted by the Company. The Company reserves the right to cancel the accounts of customers who violate these standards or create fake accounts.
Intellectual Property Rights
All rights reserved; the contents of this platform, including, but not limited to, videos, texts, graphics, images, logos, links, charts, audio recordings, button icons, digital downloads, materials available for re-download, software, and data compilation, and all content from the Company and/or its suppliers or any third party, are the exclusive and proprietary property of the Company, protected by intellectual property rights.
The Company reserves all copyrights, trademarks, patents, intellectual property rights, and other proprietary rights in the information and services contained on this platform in any form. Any unauthorized use, publication, storage in a retrieval system, reproduction, or printing of the information and services contained on this platform is strictly prohibited and subject to Egyptian copyright law, international copyright law, and agreements such as the Berne Convention and TRIPS.
The Company’s logo, the name “GOTALKY,” and its logo are trademarks of Lang Talks Information Technology Company. Any other trademarks mentioned on this platform are registered trademarks of the Company in Egypt and other countries. Images, logos, button icons, texts, and other service names are the exclusive trademarks and trade designs of the Company. Reproducing these trademarks or trade designs in any way without express written permission is prohibited and can harm the reputation and credibility of the Company.
Liability and Legal Responsibility
The platform is provided on an “as is” and “as available” basis, without any representations or warranties of any kind, express or implied, regarding the use of this platform, its content, or the materials contained on it. You expressly agree that you are using this platform at your own risk. The Company disclaims all legal liability that may result from the use of this platform, whether implied or express, to the fullest extent permitted by law. The Company makes no guarantees that this platform or the network delivering the service is free from viruses or other harmful components. The Company will not be liable for any loss or damage of any kind arising from the use of this platform, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
Disclaimer
It may happen that our platform becomes unavailable due to planned maintenance or unforeseen technical issues. Instructors may provide misleading information in their courses, or we may face security problems. These are examples, and you agree that you will not have any recourse against us in any such instances. The services and their content are provided “as is” and “as available.” The Company and all its platforms do not make any warranties or representations regarding the suitability, reliability, availability, timeliness, security, or accuracy of the services or their content, and we explicitly disclaim any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We may decide to stop offering certain services or features at any time for any reason. Under no circumstances will GOTALKY or the Company be liable for any damages resulting from such interruptions or unavailability.
We are not responsible for delays or failures in performing any of the services due to causes beyond our reasonable control, such as acts of war, hostilities, sabotage, natural disasters, power, internet, or communication outages, or governmental restrictions.
Governing Law
By visiting the platform, you acknowledge that the Terms and provisions set forth in this document are subject to the laws in force in Egypt, without regard to conflict of law principles, and that any dispute arising from it shall be subject to the exclusive jurisdiction of the Egyptian courts.
General Terms for “GOTALKY Platform”
By registering and using the GOTALKY platform, you agree to these Terms and Conditions.
You agree not to use the GOTALKY platform in a way that disrupts service or prevents other users from accessing it. You also agree not to present yourself under a false identity when interacting with other users of the platform.
Platform Security Measures
Users are prohibited from violating or attempting to violate the platform’s security measures, including, but not limited to:
Any violations of the system, network, or platform may result in civil or criminal liability. The Company will investigate these violations and cooperate with relevant authorities to pursue users involved in such violations.
Indemnification
If you breach any of these Terms of Service, you agree to defend, indemnify, and hold harmless the Company, its affiliates, directors, officers, agents, employees, and all third-party claims, actions, or demands arising from or related to your use of the platform, including any liabilities, expenses, damages, judgments, and legal costs of any kind.
